PARTICIPANT AGREEMENT
THE BOARD WALKS PARTICIPANT AGREEMENT & WAIVER
The Board Walks is a free community walking service operated by High Vibe Ventures LLC, a Nevada limited liability company ("HVV"); The Board Walks is an HVV program and not a separate legal entity.
Acceptance and Scope
By completing an official registration, RSVP, or check-in process authorized by The Board Walks, you acknowledge that you have been provided access to this Agreement and agree to its terms for the event identified in that process. Authorized processes include RSVPing through an official The Board Walks Meetup event and any other registration or check-in method designated by The Board Walks.
Each registration, RSVP, or check-in constitutes acceptance of the version of this Agreement presented or linked for that event. This Agreement applies only to events for which you complete an authorized process and does not apply retroactively to earlier events.
You may not register, RSVP, or check in under another adult’s identity or accept this Agreement on another adult’s behalf. A parent or legal guardian registering or checking in a participant under 18 accepts this Agreement on the minor’s behalf and remains responsible for the minor throughout the event.
Privacy
The collection and use of personal information associated with registration and participation are described in our Privacy Policy here.
Assumption of Risk
I understand The Board Walks events involve roughly 5 miles of walking in public spaces with inherent risks including injury, illness, death, weather, uneven terrain, traffic, falls, contact with others, and communicable diseases. I certify I am in good physical health and able to participate safely without medical advice to the contrary. I VOLUNTARILY ASSUME ALL RISKS.
Release of Liability
I RELEASE, WAIVE, AND COVENANT NOT TO SUE High Vibe Ventures LLC (including its brands and programs, including The Board Walks) and its owners, officers, employees, contractors, volunteers, hosts, and affiliates ("Released Parties") from ANY LIABILITY for injury, death, property damage, or loss arising from my participation, including ordinary negligence (but excluding gross negligence, willful misconduct, and non‑waivable claims); The Board Walks does not own or control the public spaces used.
Indemnification
I will defend, indemnify, and hold harmless the Released Parties from third‑party claims, damages, and reasonable attorneys’ fees arising from my participation, breach, or injury I cause to others, except to the extent caused by a Released Party’s gross negligence or willful misconduct.
Personal responsibility
I will not participate while impaired by alcohol, cannabis, illegal drugs, or misused medications, and I will not bring, consume, sell, share, or distribute such substances at any event. I am responsible for my safety, checking weather, and my property. I will leave immediately if I feel unwell or unsafe.
No insurance
The Board Walks does not carry liability insurance. I am responsible for my medical costs, injuries, and losses, and authorize emergency medical care at my expense if needed.
Emergency protocols
I authorize transport at my expense, consent to disclosure of my emergency contact to medical personnel if needed, and acknowledge Hosts and HVV are not medical professionals and have no duty to render aid.
Hosts
Hosts are volunteers, not employees, and provide no professional instruction, individualized supervision, physical assistance, or medical care. Hosts may, in their sole discretion, deny entry or remove any participant for safety, disruptive behavior, or Ground Rules violations, with no appeal.
Ground Rules
I agree to follow The Board Walks Ground Rules, which are incorporated by reference and may be updated with 30 days’ advance notice on the site; the version in effect at acceptance applies.
Media release
Attendance requires consent to photography and recording. I grant The Board Walks an irrevocable, perpetual, worldwide, royalty‑free license to use photos, videos, or recordings of me for any lawful purpose, including commercial use; provided, however, The Board Walks will not publicly share recordings of clearly private one‑on‑one conversations identified as confidential. If I do not consent, I may not attend.
Brand and materials
You may refer to your attendance but may not use The Board Walks or High Vibe Ventures names, logos, or branding to imply sponsorship, endorsement, or affiliation, and you may not copy, distribute, or teach from The Board Walks scripts, training materials, or content without prior written permission.
Private events
Events are private. HVV or Hosts may deny entry or remove anyone for safety, disruption, or Ground Rules violations in HVV’s sole discretion without appeal. We make no guarantees about safety or outcomes. Events may be modified or canceled anytime.
Minors
The walks are designed primarily for adults. Participants under 18 may attend only with a parent or legal guardian who remains present and responsible for them throughout the walk.
Legal terms
This Agreement is governed by Nevada law, without regard to conflict‑of‑laws principles. If any provision is unenforceable, the rest remains in effect. This Agreement binds and benefits my heirs, executors, administrators, and personal representatives. Disputes shall be resolved by binding arbitration in Nevada under AAA rules after a 30‑day good‑faith informal resolution period; emergency equitable relief for intellectual property or confidentiality may be sought in state or federal courts located in Nevada. YOU WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN CLASS, COLLECTIVE, OR REPRESENTATIVE ACTIONS. HVV may modify this Agreement with at least 30 days’ notice through email, the website, or an authorized registration platform. A revised version applies when you subsequently complete an authorized registration, RSVP, or check-in process after receiving notice of the revision. If you do not agree to the revised Agreement, you may not register for or participate in an event governed by it.
Notice mechanics
Notices, updates, or amendments may be provided by email to your address on file and/or conspicuous in‑platform notice. You must keep your email current.
Arbitration details
Arbitration shall be administered by the American Arbitration Association under its Consumer Arbitration Rules (if you are an individual attendee) or Commercial Arbitration Rules (if you register on behalf of an organization). HVV will pay all filing, administrative, and arbitrator fees that exceed the cost you would pay to file the same claim in a Nevada state court; the arbitrator may reallocate fees as permitted by law. The arbitrator shall have the exclusive authority to resolve disputes regarding the formation, interpretation, applicability, enforceability, or validity of this arbitration agreement and the class/jury waivers, except that a court may decide issues of public injunctive relief where required by law.
Any court proceedings permitted under this arbitration agreement shall be brought in state or federal courts located in Nevada, and the parties consent to personal jurisdiction there.
Local law / Permits
To the maximum extent permitted by law, the release, waiver, dispute resolution, and class/jury waivers apply. Where local law prohibits any provision, it is modified to the minimum extent necessary and the remainder remains enforceable. You are responsible for complying with local laws and any permit requirements; HVV and Hosts do not represent that any route or public space is permitted for group use.
